Privacy Policy

Insurance Brokers of Nigeria Limited (“IBN”, “we”, “us” or “our”) is Nigeria’s premier insurance Broker. Our main service is insurance brokerage and risk management (the “Services”). We arrange insurance policies on behalf of policyholders (our “Clients”) and also assist in managing claims arising from those policies.

In order to carry out our Services, we are required to collect and process certain information from our clients. IBN is committed to safeguarding the personal data of our clients and individuals who visits our website and engages with our services, and as such, we ensure that all personal data received from you are only used and processed in compliance with applicable data protection laws.

This Privacy Policy explains how we collect, use, process, disclose and protect your personal data in accordance with the Nigeria Data Protection Act (NDPA) 2023 and other applicable data protection laws and regulations.

Scope

This Privacy Policy applies to all users of our services as well as visitors to our website. It governs how we handle personal data you provide to us to enable us provide our services to you.

For our platform visitors, our website is primarily an informational and service-request platform. We do not collect personal data beyond what is necessary for communication and provision of our services.

Consent

By accessing or using our website or any of our services in any manner, you indicate to us that you have read and accepted this Privacy Policy and consented to the data practices described in this Policy. You agree that in granting us your consent, you have the legal capacity to give consent and you are aware of your privacy rights and your option to withdraw your consent at any given time. We collect Personal Data only for identified purposes and for which consent has been obtained.

The Personal Data We Collect

  • c. Your means of identification such as your international passport, national identification number (NIN) and driver’s license
  • d. Demographic information (i.e., age, country of birth, occupation);
  • e. Information that you provide to us through your completion of customer documentation forms or via telephone.
  • f. financial information, such as payment information, including name, billing address and payment details (e.g, credit/debit cards, bank verification number, bank details, and other information required for billing and fraud prevention);
  • g. Marketing and promotional information (such as information about services we offer and your choices); and
  • h. any other information that is needed to be able to provide our services or other insurance or financial services for you and on your behalf.

We may also request access to your device’s camera and media gallery to allow you upload pictures, videos or other files where necessary to enhance your experience on our website.

How We Collect Personal Data

We collect data from you when you complete a contact form on our website to request our services; you send us an inquiry via email through the website; or you provide details voluntarily for communication purposes.

We also collect your data when you complete our customer account opening form. You may decline to provide Personal Data; however, there are certain information that are mandatory for registration and access to our services. If you choose not to provide the mandatory information required, we may be unable to provide services to you, and some optional features, including personalization, may not work as expected. By providing this information, you consent to our collection, use, and disclosure of your personal data in accordance with this Privacy Policy.

Legal Basis for Processing Your Personal Data

We have legal basis to process your data on any of the following reasons:

  • Consent: You give consent when you sign up, access, or use our services offered on our website. You also have the right to refuse to consent or withdraw your consent at any time by contacting us at lcdsupport@ibn.com.ng. However, withdrawal of consent will not affect the lawfulness of any processing carried out before you withdraw your consent.
  • Performance of a Contract: We may also process your information on the basis that we need to perform and fulfill a contract with you for the provision of our Services or to take steps at your request prior to entering a contract.
  • Legal Obligation: We may process your information where a legislation specifically mandates us to or if it is necessary to respond to a lawful request from a law enforcement or regulatory authority, body or agency; in the defense of legal claims or in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person.
  • Vital Interest: We may process your information where it is necessary to protect an interest, which is essential for your life, health and bodily safety or that of another natural person’s. This basis is limited in scope.
  • Public Interest: We may process your information where it is necessary for the performance of a task carried out in the public interest or in order to fulfil a public mandate imposed on us.

How We Use Personal Data

We may use the Personal Data collected from you:

  • to contract with you and provide our Services to you;
  • to analyse and improve the safety and security of our products and Services;
  • to create, administer, and communicate with you about your account;
  • to fulfil a specific request and provide customer support, such as responding to inquiries and handling complaints;
  • to improve the accuracy of our records so that we can better understand your needs and preferences;
  • to contact you regarding our services;
  • to carry out client communication, deal with client complaints, and administer claims;
  • to carry out “Know Your Client” checks and screening prior to starting a new engagement;
  • to contact you in relation to current, future and proposed engagements, send you our newsletters, know-how, promotional material and other marketing communications
  • to defend against fraud (and this may include the verification of identity), or to verify the legitimacy of a legal claim;
  • to maintain and protect the security of our products, Services and Online Channels, preventing and detecting security threats, fraud or other criminal or malicious activities;
  • in the event of a merger, sale or other transfer event, in which Personal Data held by us about you is among the assets transferred;
  • for commercial purposes: to contact you about products and services that we believe may be of interest to you; and to provide your information to third parties;
  • to meet legal and regulatory requirements, including complying with court orders, valid discovery requests, valid subpoenas, reporting of money transfers above thresholds, reporting suspicious activities, and other appropriate legal mechanisms; and
  • to ensure client satisfaction and fulfil other purposes disclosed at the time you provide Personal Data or otherwise where we are legally permitted or are required to do so.

Where we need to process your Personal Data for additional purposes that we have not identified at the time of collection, we will make sure to obtain your consent or the appropriate legal basis for these additional uses to the extent required by applicable law.

Transfer to Third Parties

We may be required to share or disclose personal information about you internally, and externally with third parties as part of the provision of our services, management and operation. Such third parties include insurance companies and other parties within the policy and claim administration process, business partners, affiliated companies within our corporate structure, law enforcement and regulatory agencies, government agencies and as needed for legal and regulatory purposes. These third parties are contractually and/or legally bound to use the personal information only to perform the services that we engage them to provide or to comply with applicable laws.

Transfer outside the Country

By signing up on this Platform, you are consenting to the transfer, storage, and processing of your personal information outside of Nigeria or other countries, as may be necessary. We shall take reasonable steps to ensure that any such overseas entities are contractually bound not to use your personal information for any reason other than to provide the services they are contracted by us to provide and to adequately safeguard your personal information.

Privacy Policy For Children

Our website and services are not intended for use by persons under the age of 18 (“Child” or “Children”). We do not knowingly collect personally identifiable information from Children under 18. If you become aware that a Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we will take the necessary steps to delete that information from our servers.

How We Protect and Store Personal Information

Data received is automatically synced and saved in our cloud servers and other very secured environment. We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. and to the extent necessary to comply with our legal obligations (for example, our obligation to retain your data to comply with applicable laws from the National Insurance Commission and other regulators), resolve disputes, and enforce our legal agreements and policies.

We take precautions to protect your information. We use industry standards for encryption over the Internet to protect in transmission the Personal Data we collect online. All electronic Personal Data that we maintain is securely stored and further protected through our use of appropriate access controls. When you submit sensitive information via our Platforms, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. With respect to our website, you can verify this by looking for a closed lock icon or "https" at the beginning of the address of the web page.

We restrict access to your data to the employees of the Company on a need-to-know basis to enable them provide our services to you. We also have an internal privacy policy which governs how employees treat your data. Third parties which have access to data to perform their functions may not use it for other purposes.

While we take extensive measures to keep your data safe, please note that no security control or system is 100% effective. We cannot guarantee that the data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. We have however put in place procedures to deal with any suspected data security breach and will notify you as soon as reasonable.

Please note that you are responsible for maintaining your password, banking information and other sensitive data secure at your end and we will not liable for any security breach arising therefrom. We are not liable for any breach that may occur from a Third-party’s end. We will however, employ best endeavours to resolve same.

Cookies

Cookies are small pieces of text used to store information on web browsers. Cookies are used to store and receive identifiers and other information on computers, phones, and other devices. Other technologies, including data we store on your web browser or device, identifiers associated with your device, and other software, are used for similar purposes. In this policy, we refer to all of these technologies as “cookies.”

We do not currently use cookies. However, in the event cookies are onboarded, our users will be provided with options to accept, reject or manage cookies in accordance with the Nigerian Data Protection Act 2023.

You have certain rights, as are further detailed in the Nigerian Data Protection Act 2023. These rights are (i) a right to access (a record that shows, inter alia, what data is being processed about you), (ii) rectification (right to correct or update information previously shared with us), (iii) erasure (right to be forgotten), (iv) restriction of processing (v) right to request the transfer of your personal data to a third party of your choice (vi) Right to object to the processing of your data (vii) right to withdraw consent (you can withdraw consent at any time but it does not affect any lawful processing of your data carried out before you withdrew consent).
